These terms apply to all guests ("Participant") joining water sports and sea activities offered by No Name Water Sports ("the Business") at Ölüdeniz Belcekız Beach. Anyone who joins an activity, makes a payment or uses our equipment is deemed to have read, understood and accepted the terms below.

1. Voluntary Assumption of Risk

Water sports are inherently risky activities. Parasailing, jet ski, towables (phantom, mable, big mable, ringo, banana, sofa), wakeboard, water ski and similar activities involve natural risks such as speed, height, loss of balance, falling, impact and exposure to water. The Participant acknowledges being aware of these risks and joining the activity entirely of their own will and with knowledge of the risk.

2. Health Declaration and Participant's Responsibility

The Participant declares that they have no health condition preventing participation. In the following cases, the Participant must inform the Business beforehand:

Pregnancy,
Heart, blood-pressure, respiratory or neurological conditions,
Back, neck, shoulder, knee or other orthopaedic conditions,
Recent surgery, fracture or injury,
Inability to swim,
Any other health condition that may affect the activity.

The Participant is personally responsible for any consequences arising from failing to provide accurate and complete information about themselves. The Business cannot be held responsible for harm arising from a health condition that was not disclosed to it.

3. Compliance with Safety Instructions

The Participant agrees to fully follow the safety briefing, instructions and warnings given by our team and captains. A life jacket is mandatory on all activities and may not be removed during the activity. The Participant is responsible for harm arising from failure to follow instructions or from misuse of the equipment.

4. Alcohol and Drugs

People under the influence of alcohol or drugs are not accepted on any activity. The Business reserves the right to refuse such a Participant and is not responsible for any resulting service cancellation.

5. Age, Weight and Capacity Limits

Each activity has age, weight and capacity limits set for safety. These limits are for the Participant's safety and are not relaxed by the Business. Participation by minors is possible with the permission and/or accompaniment of a parent or guardian; the parent's/guardian's approval means these terms are accepted on their behalf too.

6. Weather and Sea Conditions — Cancellation and Postponement

Participant safety comes before everything. Only the Business decides whether wind, waves, visibility or other weather/sea conditions are unsuitable, in which case the activity is postponed or cancelled. In such cases:

The activity may be moved to a suitable time the same day or to another mutually convenient day.
The Business cannot be held responsible for activities that cannot run due to weather; this is not considered a service fault.
The Business has no obligation if the Participant does not show up of their own choice or is late.

7. Belongings and Valuables

Taking personal items such as phones, sunglasses, jewellery and watches during the activity is not recommended, and our team's warnings on this must be followed. The Business is not responsible for personal items lost, damaged or dropped in the water during the activity.

8. Images and Recording (Photo / Video)

Within its professional photo, drone video and GoPro services, the Business may record the Participant's image. These services are paid and offered on request. The Business may use general (where the person is not prominently and identifiably featured) activity images for promotion, social media and website purposes. If the Participant does not want images in which they are identifiably featured to be used for promotion, they may notify the Business in writing before the activity.

9. Limitation of Liability

The Business takes due care in maintaining its equipment, employing competent staff and taking safety measures. However, the Business cannot be held responsible for harm arising from the Participant's failure to comply with these terms, the safety instructions or the health-declaration obligation, from their own fault, or from an undisclosed health condition. The Business's liability is limited to the applicable legal framework, subject to the mandatory provisions of the relevant legislation.

10. Right to Refuse Service

The Business reserves the right to refuse or stop any activity for reasons such as safety, weather conditions, the Participant's condition or non-compliance with these terms.

11. Pricing and Payment

Prices vary by season, activity, number of people and selected add-ons, and current prices are given by the Business before the activity. Payment and any deposit terms are agreed mutually before the activity.

12. Governing Law and Jurisdiction

These terms are governed by the laws of the Republic of Türkiye. In any disputes, subject to the mandatory provisions of the relevant consumer legislation, the Courts and Enforcement Offices of Fethiye have jurisdiction.
